Fencher Safaris Uganda

These Terms and Conditions govern all safari bookings, quotations, and travel arrangements made with Fencher Safaris Uganda (“Fencher,” “we,” “us,” or “our”), a fully licensed Destination Management Company registered with the Uganda Tourism Board and the Uganda Wildlife Authority. By submitting a deposit or confirming a booking, whether directly or through a Travel Advisor acting on your behalf, you (“the Client” or “the Traveler”) agree to be bound by these Terms and Conditions.
Custom itineraries. Every itinerary arranged by Fencher is custom built around the Client’s dates, interests, and party size. No booking is treated as final until a signed confirmation and the required deposit have been received.
Deposit. A nonrefundable deposit of 30% of the total trip cost is required to confirm a booking and to secure gorilla or chimpanzee trekking permits, park entry fees, and accommodation availability on the Client’s behalf.
Balance payment. The remaining balance is due no later than 60 days before the trip start date. For bookings made within 60 days of travel, full payment is due at the time of booking.
Currency and method. All quotations are provided in US Dollars. Payment may be made by bank transfer or another method agreed with Fencher or the Client’s Travel Advisor. Bank charges and transfer fees are the responsibility of the Client.
Because gorilla and chimpanzee trekking permits, park fees, and select accommodations are paid to the Uganda Wildlife Authority and partner lodges in advance and are nonrefundable to Fencher once purchased, cancellations are subject to the following schedule, calculated from the date written cancellation notice is received:
Gorilla and chimpanzee trekking permits are nonrefundable and nontransferable once purchased from the Uganda Wildlife Authority, regardless of the cancellation timeline above, except where the Uganda Wildlife Authority itself issues a refund, in which case Fencher will pass on any amount actually recovered.
Requests to change travel dates, itinerary content, or party size are handled on a best effort basis and are subject to availability of permits, accommodation, and park access at the time of the request. Date changes made less than 90 days before travel may be treated as a cancellation and rebooking under Section 3 if permits or accommodations already secured cannot be transferred.
Where a refund is due under Section 3, Fencher will process it within 30 business days of confirming the cancellation and reconciling any amounts already paid to the Uganda Wildlife Authority, lodges, and other suppliers on the Client’s behalf. Refunds are issued in the same currency and by the same method as the original payment wherever possible.
The Client is responsible for ensuring they hold a valid passport with at least six months’ validity beyond the travel dates, any required visa or East Africa Tourist Visa, and any vaccination or health documentation required for entry into Uganda. Fencher can advise on current requirements but is not responsible for a Client being refused entry, a permit, or boarding due to incomplete documentation.
Fencher strongly recommends that every Client obtain comprehensive travel insurance covering trip cancellation, medical treatment, emergency evacuation, and loss of baggage before departure. Proof of insurance may be requested prior to gorilla or chimpanzee trekking, in line with Uganda Wildlife Authority guidance for high altitude trekking activities.
Fencher does not itself hold a general liability or vehicle insurance policy. Instead, all ground transport, game drives, and trekking support services are provided through registered, licensed partner companies who carry their own vehicle and public liability insurance. For each confirmed trip, Fencher compiles and shares the relevant provider insurance documentation, including vehicle insurance and driver certification, with the Client or their Travel Advisor ahead of arrival. This has been Fencher’s standard operating practice with all Clients to date.
Fencher will exercise reasonable skill and care in arranging each itinerary and selecting reputable, licensed suppliers. Fencher’s liability is limited to the direct cost of the specific service that failed to be provided as booked. Fencher is not liable for injury, loss, delay, or expense arising from circumstances beyond its reasonable control, including wildlife behavior, weather, road conditions, park closures, or acts of third party suppliers, except where caused by Fencher’s own negligence.
Neither party is liable for failure to perform an obligation under these Terms where that failure results from circumstances beyond reasonable control, including natural disaster, epidemic or disease outbreak, civil unrest, government action, or park or border closures. Where a trip is affected, Fencher will work with the Client to reschedule or apply payments already made toward a future trip wherever park and supplier policies allow.
All Clients must comply with Uganda Wildlife Authority rules during gorilla and chimpanzee trekking, including the minimum trekking age of 15, maintaining the required distance from wildlife, and following ranger and guide instructions at all times. Fencher reserves the right to remove a Client from an activity without refund where their conduct endangers themselves, other travelers, staff, or wildlife.
These Terms and Conditions are governed by the laws of the Republic of Uganda. Any dispute arising from a booking will first be addressed through good faith discussion between the parties and, if unresolved, through mediation, before either party pursues further legal action.
